Short-Term Rental License

Are you interested in earning some extra money by posting your house on a vacation rental website like Airbnb or FlipKey? You will need to get a short-term rental license first.

Types of Short-Term Rentals

Short-term rental is when you rent to overnight guests on a daily or weekly basis for periods of less than 30 days.

Salem offers two types of short-term rental licenses:

Whether a proposed rental is classified as a short-term rental or accessory short-term rental depends on:

  • The type of home that will be rented
    • Short-term rentals are allowed only in a single family dwelling unit or condominium dwelling unit.
    • Accessory short-term rentals are allowed only in a single family dwelling unit, two family dwelling unit, condominium dwelling unit, or guest house.
    • Short-term rentals and accessory short-term rentals are not allowed in three family, four family, or multiple family dwelling units.
  • Whether or not you live in the home to be rented
  • The number of guest rooms that will be rented
  • Whether you will rent the entire home for periods of time when you are away, and for how long
  • The zoning of your property

License Required

You must have a license to operate a short-term rental or an accessory short-term rental in Salem. A license is valid for one calendar year. All licenses expire on December 31 and must be renewed annually to continue operation (SRC 30.1000 and SRC 30.1100).

Licenses are specific to the designated operator and property and cannot be transferred to other people or properties.

New License Application Process

Safety Certification and Inspections

In order to ensure conformance with City regulations, including the safety requirements of the City’s Housing Code (SRC Chapter 59), applicants for short-term rental and accessory short-term rental licenses are required to a complete a safety certification attesting that the rental to be licensed meets the safety requirements. After a license is issued, a physical inspection of the rental will be made to verify conformance with the applicable requirements.

Frequency of Inspections

  • Short-term rentals require an inspection every year. 
  • Accessory short-term rentals require an inspection at least once every five years.

Renewals

Short-term rental and accessory short-term rental licenses must be renewed every year. Renewal applications must be submitted within 30 days of the expiration date on your existing license. Your renewed license is effective as of the expiration date of your prior license. If you do not turn in an application to renew your existing license before it expires, you must get a new license.
